By accessing BottegaZeroWaste.com and its subdomains (the "Sites"), you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. By using these Sites, you agree to these terms of use. We reserve the right to modify these terms at any time, without notice, so please check this page periodically for changes. By using these Sites, after we post any changes to these terms, you agree to accept those changes, whether or not you have reviewed them or been notified about them. If at any time you choose not to accept these terms of use, please do not use this Site or any of our other Sites
2. Preliminary Considerations
For the purposes of these Terms of Use and our associated Sites, it will be understood as:
- "Participant", "Student", "Member", or "User": any user who has decided to buy and access any of the products or services that are for sale on our Sites;
- "Course", "Membership", or "Plan": any free or paid courses, or any digital materials provided to members on our Sites, which can be accessed through an internet browser;
- "Content": any information, materials, documents, images, videos, or audios made available through our Sites
3. Intellectual Property & Use License
The contents of our Sites are protected by copyright and trademark laws, and are the property of ours. You cannot repost or resale any of our content without express written permission, as it is our protected or proprietary content and assets. Make Your Own Academy, Zero Waste Haircare, Soap Making for Zero Wasters, and Zero Waste Make-up are digital products owned by Bottega Zero Waste, and all information on our Sites is copyrighted by the designee on the footer.
Unless otherwise noted, you may access and use the information and materials within the Sites for your personal use only. You may not change, modify, delete, display, transmit, adapt, exploit, or copy for distribution or sale any information, material, trademark, or copyright on the Sites, or any of our affiliated Sites. You must obtain written permission from us or any other entity who owns intellectual property on the Sites before you may publish, distribute, display, or commercially exploit any material from the Sites and if you do not gain our written permission you will be held liable for significant damages. By using the Sites, you agree to these restrictions and to abide by all copyright notices.
The participant will not be able to use this material for any other purpose than that of their own learning. This is the grant of a license, not a transfer of title, and under this license you may not:
- distribute, modify, or share copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on the Site;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or 'mirror' the materials on any other server or site.
This clause is applied to all types of content, whether textual, multimedia, sound, images, photographs, responses in the forum, emails, notes, voice or any other type of file regardless of its form. You may sell the products you make according to what you have learned in the courses, however, at no time can you indicate the formulas used, or any secret or framework that has been shared with the participants. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Bottega Zero Waste at any time. Upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
Any unauthorized use or distribution of our Sites proprietary concepts, materials, and intellectual property by you or your representatives are prohibited. We will pursue legal action and full damages if any of these terms are violated in order to protect these rights.
4. Affiliate Links & Disclosures
If we use affiliate links, which are links to our partners or sponsors who pay us if you sign up or purchase from them, then we will tell you on the page we are linking to them from. Any action you take on another company’s site is up to you and you are solely responsible for your actions and purchases with them. If we are paid by an affiliate, it does not cost you any extra – they are compensating us for driving traffic to them. Often, we are able to get you discounts and trials to companies or products we like; and we only recommend companies or products we like.
5. Events Changes
The events, included but not limited to Q&As, coaching sessions, videos, webinars, and podcasts, which are organised by Bottega Zero Waste, as well as topics, information, freebies, deadline for registration, eligibility for bonuses, and speakers are subject to change without notification.
6. Submissions
We welcome your comments about any of our Sites. Any feedback or suggestions submitted by you aimed at improving our content, courses, products, and materials shall become our property. To avoid the possibility of future misunderstandings in the event that ideas developed by our staff might seem to be similar to any ideas that were submitted to us, we must ask that you not send us any original creative ideas, projects, or materials. If, despite our request, you send us any idea or material (“Submission”), it shall become our property. We will not be subject to any obligation of confidence for any Submission, and we will not be liable for any use or disclosure of any Submission. In the case that you submit something to us and it is unsolicited, we will exclusively own all rights to the Submission worldwide, and we will be entitled to the unrestricted use of the Submission for any purpose, without compensation or notification to the provider of the Submission. Given this fact, we ask that you refrain from submitting creative projects to us, particularly those that are confidential or personal to you.
7. Limitation of Liability
Under no circumstances, including but not limited to negligence, will we, our affiliates, or any of our licensors or suppliers, be liable for any special or consequential damages that result from the use of, or the inability to use, the materials or information on the Sites, or any products or services provided pursuant to the Sites, even if advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability, or incidental or consequential damages (including but not limited to lost data), so the above limitation or exclusion may not apply to you. In no event shall the total liability to you by us, or any of our licensors or suppliers, for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you to us, if any, for accessing the Sites.
Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of any advice, goods or services you receive from a guest speaker on our Sites or at one of our events.
We are also not responsible or liable for any loss or damage that is caused, or alleged to have been caused, to our guest speakers in connection with the display of their photo, name, or biography posted on our Sites or in our marketing materials.
8. No Professional Advice
The information contained in or made available through the Sites or through our affiliated Sites (including but not limited to information contained on message boards, in text files, or in chats) cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, financial, medical, psychological, therapeutic, chemical, or legal matters. In particular, you should regularly consult a doctor in all matters relating to physical or mental health, particularly concerning any symptoms that may require diagnosis or medical attention. We and our licensors and suppliers make no representations or warranties concerning any treatment, action, or application of medication or preparation by any person following the information offered or provided within or through the Sites. Neither we or our affiliates, nor our partners or any of their affiliates, will be liable for any direct, indirect, consequential, special, exemplary or any other damages that may result, including but not limited to economic loss, injury, illness or death. You alone are responsible and accountable for your decisions, actions and results in life, and by your use of the Sites, you agree not to attempt to hold us liable for any such decisions, actions or results, at any time, under any circumstance.
9. Non-Academic Institutions
Please note that Bottega Zero Waste is not an accredited academic institution and does not issue diplomas or academic certifications or degrees. We do not accept student loans or provide student aid under any programs. We are a for-profit training centre for personal development.
10. Results Disclaimer
Our programs take a lot of work and discipline just like any worthwhile endeavour or professional continuing education program. As stipulated by law, we cannot and do not make any guarantees about your ability to get results or earn any money with our ideas, information, tools or strategies. Bottega Zero Waste is only obliged to offer you the contents of the course you decide to enrol in. At no time will it be held responsible for your success or failure in the application of this knowledge. You are solely responsible for applying what you have learned in the courses. Your results in life are only up to you. We want to help by giving great content, direction, and tips. Any information or reference made here, on our newsletters, on social media networks, or on any of our Sites (included but not limited to ingredients, materials, tools, accessories, safe measures, and others) is given, at all times, for educational and informational purposes, and should not be considered professional advice (legal, medical, tax, chemical, healthcare, or others), promises for actual or future performance, or guarantee of results and future earnings. You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, and under any circumstance.
11. Permitted Users
The Sites are not directed to children under the age of 18 and we will not knowingly collect personally identifiable information from children under 18. By accessing our Sites, you confirm you are at least 18 years of age or older.
Bottega Zero Waste reserves the right to admit students into a certain course, without the need to explain the reasons why such selection has been made.
We are entitled to block access to the course, or to the Sites in general, to those users who infringe the T&Cs or those of third parties, whether in terms of personal data, copyright, industrial property or any other applicable rules.
12. Payment Methods
You may be required to process a payment to access one of the courses or memberships on our Sites. You have the option to pay with your credit, debit card, PayPalⓇ, or even Apple PayⓇ and Google PayⓇ depending on the instructions provided by Teachable, Inc -- the platform used to host our courses and materials.
Teachable, Inc and their affiliated payment gateways will be solely responsible for holding, storing, and encrypting bank details and any other billing information provided by you, as these do not become known to Bottega Zero Waste at any time. In the event of any problem related to payments or misuse of this type of data, you may be required to contact Teachable, Inc directly. Bottega Zero Waste is not responsible and accountable for any data leaks, data or economic loss, and by your use of the Sites, you agree not to attempt to hold us liable for any such loss or damage, at any time, under any circumstance.
13. Payments, Charges, and Access
Bottega Zero Waste reserves the right to add, update, or remove payment options on all the digital products and services listed on our Sites, and to add any applicable setup fees at checkout, at any time without notification.
Our courses, such as Soap Making for Zero Wasters, Zero Waste Haircare, and Zero Waste Make-up, operate under a one-time payment option. Once you're enrolled, you get lifetime access to the course, its modules, lectures, and materials immediately.
Our memberships, such as the Make Your Own Academy, typically have only two pricing options: a one-time payment, and a payment plan plan consisting of recurring charges. By enrolling in one of these memberships, you authorise Teachable, Inc to automatically collect payments every month on the card provided at the time of registration, or changed thereafter, until the end of the payment plan. At the time of purchase you lock the price specified at checkout for the lifetime of your membership. Once you're enrolled, you get access to the plan and its first lecture section immediately. In line with the concept of academy and educational programs, Bottega Zero Waste chose to release (i.e. drip) published lectures and materials on a specific amount of days after a student enrols. This means that you will not be able to access a lecture section until it has been "dripped" to you. If a lecture section is to be dripped on a specified date, or a specified amount of days after enrolment, it will be released at midnight/0:00 UTC (Universal Time Coordinated) of the specified date/amount of days after enrolment. Email announcements, if enabled, will be sent out at 3:00PM/15:00 UTC (15 hours after the lecture section drips).
If you purchase one of our products from the UK or a EU country, the applicable digital VAT or tax is added automatically to the sale price at checkout. If you intend to purchase a course or membership as a business entity and have a valid VAT ID, you may enter your VAT ID on the checkout page. This will ensure that the transaction is processed as a sale to a business entity. If you are located in the EU and you do not enter a valid VAT ID, the transaction will be processed as a sale to a consumer and VAT will be charged. The reverse charge rule applies to most sales to a business entity. If the reverse charge rule applies, VAT will not be charged. However, per intra-community supply rules, if the supplier and the student are established in the same EU country, VAT will be charged. The receipt will note whether the transaction is subject to reverse charge or the intra-community supply of services, as applicable. Note that you must include the two-digit country code when entering in your VAT ID at checkout.
Once the payment has been made, an electronic invoice is sent to the email provided.
14. Enrolment
Immediately after you formalise your enrolment, you will receive an email which includes all the relevant steps to access the Site, and if applicable, to grab your "bonuses".
To access the Site you will need to use your credentials, including your personal password. You are solely responsible for the custody of this data.
Bottega Zero Waste reserves the right to prohibit or remove access to the course, if at any time, an user violates these T&Cs or any other policies of the Sites.
15. Discounts
In the event Bottega Zero Waste decided to offer any discount or promotion, this would only apply at the time of purchase. Such promotions may be valid for a limited time or for a limited number of clients. Bottega Zero Waste reserves the right to decide when a promotion or discount should be given, and to review their terms at any time without notification. The demand for a retroactive discount or promotion will not be valid, nor will the difference be returned.
Bottega Zero Waste is not responsible for the promotions or discounts of products and services for those third parties, which are advertised on our Sites, social networks, materials, or newsletters. Any query or controversy must be dealt directly with the third party who has offered such promotion or discount.
16. Student Refund Policy
Bottega Zero Waste works hard to provide only quality products and services and to meet the growing needs of our students. As a result, we want you to be happy with all our courses and memberships.
Therefore, we offer a 14-Day Money Back Guarantee for each of our products (only limited to courses and memberships) regardless of its cost. If you are not completely satisfied with the product you purchased from us, and you have a valid reason for it, you should notify us within 13 days from the date of the purchase to allow us the time to receive your request and process the refund.
Please note: we do not accept the followings as reasons to provide a refund:
- if you have changed your mind purely because you want the money back
- if you have completed more than 20% of the course, which means you have consumed the content and clicked on the "complete" button
Additionally, before asking for a refund, we would encourage you to make the following:
- Query our Q&A page, or take a look at our cheat-sheets, PDFs, and templates. You might be able to find an answer that helps you better use the product to your satisfaction.
- Visit our private Facebook group. Perhaps others have been in the same situation and you might find a solution there that works for you as well. Moreover, our support team provides answers to many questions.
- Contact us at [email protected] to see if there is anything further we can do or try. Our support team does its best to solve any issue and to answer any query you may have.
If the above solutions do not work for you and you already made up your mind to request money back, simply send a formal request to [email protected] within 30 days of your purchase and we will process a refund for you. When requesting to return your money please let us know the reason you wish to stop using our product and service, and if there is anything we can do to help.
17. Cancellations
If you cancel a payment plan on your own, you agree to be unenrolled automatically after your current billing cycle ends. The moment your payment plan is cancelled, you will lose access to the course and its content. For these reasons, Bottega Zero Waste makes downloadable files available for part of the content in the course so that you can keep them on your computer or hard drive even if you are no longer a member of the Site. These downloadable files must be obtained during the term of the subscription and at no time will they be sent by other means after the cancellation of your enrolment in the courses or memberships.
If your credit or debit card fails for a recurring payment (e.g. payments for subscription or payment plans), then your payment will be retried on the 3rd, 8th, and 15th days after the first attempt. If you do not update your billing information at that time, you will automatically be unenrolled from the course. In fact, Teachable, Inc reserves the right to cancel the subscriptions and unenroll users who do not complete the payment of their monthly renewal.
18. Minimum Requirements Needed
You must have the minimum requirements necessary to be able to access and navigate our courses and memberships. These requirements are:
- A device such as a computer, iPad, or smartphone, including keyboard, mouse, and screen, if applicable;
- A broadband internet connection to be able to access the Sites, and to be able to correctly watch the videos and content, and download materials;
- An internet browser (e.g. Safari, Internet Explorer, Chrome, Firefox, or others);
- An audio output, including headset or earphones, to be able to listen to videos, podcasts or audios;
- A pdf reader to be able to read, update, or edit the files in pdf format
- A Microsoft Office license to be able to open, read, and update Word, Excel, or PowerPoint files
By using the Sites, you confirm that you have all the required products, device, and licenses indicated here. Bottega Zero Waste is not responsible for any failure in the access and navigation of the course if an user does not have these minimum requirements. Furthermore, at any time we are not responsible for any expenses incurred by you to access and navigate our Sites, including, but not limited to, consumption of internet data, purchase of any device, accessory, software, and licenses
19. Allergies to Ingredients
At all times, you must follow the safety measures indicated in each of the explanations or procedures within the Sites. You must monitor at all times that you do not have any allergies to any of the ingredients that make up the preparation to be made. Bottega Zero Waste is not responsible for the non-observance that you may have of the ingredients, preparation processes, temperatures, and protection measures. We always want the safety of our members at all times, however, as a consequence of this training not being a directly supervised activity, we cannot be held responsible for the non-observance of any of these rules by students.
20. Truth of Information
At all times you must ensure the information provided in our Sites or in any of our community, including private Facebook groups, does not disrespect the rights of third parties or violate the authorship of other people, whether they are members of the course or not. Bottega Zero Waste is not responsible for the content that any of the participants share as their own, the participant who mentions being the owner of said content, being solely responsible for any violation of copyright or industrial property that may exist.
We are not obliged to act as a mediator in the event of a problem that may exist between two (2) or more participants, derived from a misuse of the information or material of any of them, but reserves the right to delete any comment. of those who have violated the rules established in these T&Cs.
21. Legal Actions
Bottega Zero Waste may, at any time, take legal action of a civil or criminal nature, against any person who makes an improper use of the content displayed on the website, or for breaching these T&Cs. These Terms & Conditions shall be governed and construed in accordance with the Laws of England and you irrevocably agree to submit to the exclusive jurisdiction of the English Courts.
